SERAP takes President Buhari to court over N800bn recovered loot

The Nigerian president, Muhammadu Buhari is facing a lawsuit filed by a transparency group, the Socio-Economic Rights and Accountability Project (SERAP) over the failure to publish details about the N800bn recovered looted public funds.

The group disclosed on Sunday, Agust 30, that the suit was instituted to compel the president to disclose the dates of the recovered looted funds and details of projects on which the money has been spent.

SERAP said the suit was filed at the Federal High Court in Abuja based on the president’s disclosure during his Democracy Day speech that the government has recovered looted funds in excess of N800 billion and that these monies were being used for development and infrastructure projects.

According to the group, other respondents joined in the suit include Abubakar Malami, the Attorney General of the Federation (AGF) and minister of justice, and Zainab Ahmed, minister of finance, budget and national planning.

The President had in paragraph 78 of his speech to mark the occasion of the Democracy Day on June 12, 2020, stated that: “the government has recovered looted funds in excess of N800 billion. These monies are being ploughed into development and infrastructure projects.”

SERAP is also seeking: “an order of mandamus to direct and compel President Buhari to instruct appropriate anti-corruption agencies to promptly, thoroughly and transparently investigate alleged payment of N51bn of public funds into individual private accounts in 2019.”

“There is no reason why the information should not be made widely available to Nigerians, as the Nigerian Constitution of 1999 (as amended) requires the govt. in s 15(5) to abolish all forms of corruption. That means ensuring transparency in the management of public resources."

Meanwhile, the Economic and Financial Crimes Commission (EFCC) has made an important statement regarding President Muhammadu Buhari's anti-corruption war. The leadership of the EFCC on Monday, July 20, pointed out that it is fully in support of the presidency's stance, This Day reports.

Not only Nigerians, but top countries in the international community are also keenly interested in the ongoing probe on Ibrahim Magu by the Presidential Committee on Audit of Recovered Assets (PCARA). The agency stated that despite the mass suspension of some of its top officers, all operations are going on smoothly.
